Terms and conditions for studio rental

This document sets out the terms and conditions of TCC Group Proprietary Limited, trading under the name and style of Alcove Studio. By engaging with Alcove Studio to rent a studio on your behalf (hereinafter referred to as “the Studio”) you, the party booking the Studio (hereinafter referred to as “the Client”), hereby state that you have read, fully understand, and agree to be bound by the following terms and conditions.

“Client” is defined as the person responsible for booking and paying for the Studio rental.

  1. THE SERVICES

Alcove Studio will provide the Client with a studio space for shoots which shall be available to the Client for the rental period they have paid for.

  • BOOKINGS
    • Studio bookings can be made online or by contacting Alcove Studio directly.
    • Bookings are confirmed upon receipt of a deposit of 50% of the total rental fee.
    • The remaining balance must be paid in full on or before the first date of the rental period.
    • The Studio can be rented on either a half day basis (being a 4-hour period) or on a full day basis (being an 8-hour period). The Client must include set up and take down time within the hours booked to avoid overtime charges.
    • Overtime shall be calculated as follows:
  • Should the Client go overtime on a half day booking, they will be billed for a full day;
  • Should the Client go overtime on a full day booking, they will be billed at an hourly rate of R550-00 (this is subject to change without notice).
  • PAYMENT TERMS
    • The Client shall provide 50% of the rental fee as a reservation fee for all bookings of the Studio. The Client’s date will not be held until this payment is received and cleared by Alcove Studio.

  • All prices are quoted in South African Rand (ZAR) and are subject to change without notice.
  • RENTAL PERIOD & ACCESS
    • The rental period shall be for the dates and hours booked within the Studio’s operating hours of Monday – Friday (09:00 – 17:00). Should the Client want to book the Studio on a weekend or out of office working hours, this may be arranged with Alcove Studio, but will be subject to an out of hours surcharge.
    • Additional hours or extraordinary bookings outside of the standard booking hours for the Studio can be organised by contacting a representative of Alcove Studio at: info@alcovestudio.net.
    • The Client’s rental period begins promptly at the designated starting time and ends promptly at the designated ending time.
    • Access to the Studio shall be granted only to authorised personnel who are permitted to be in the Studio during the rental period. The Client agrees to provide Alcove Studio with a written estimate of the number of people who will be brought onto the Studio premises, and Alcove Studio reserves the right to limit the number of people allowed on the Studio premises at their discretion.
  • STUDIO USAGE & EQUIPMENT
    • Use of the Studio and its equipment is at the Client’s own risk.
    • The Studio is to be used for photography purposes only.
    • The Client is responsible for the proper use and care of the Studio and its equipment. The Client agrees to leave the Studio and its equipment in the same condition as they were when the Client arrived, fair wear and tear excepted.
    • The Studio area includes the infinity curves and walls of the Studio, as well as the common areas such as the building’s communal bathroom, the lounge area and the kitchenette.
    • The infinity curve and walls of the Studio are intended to be used as a backdrop and may not be used for any other purposes. No persons are to step on or mount anything to the walls or curve of the Studio.
    • Shoes covers will be provided upon entrance and are to be worn at all times by all persons entering the Studio so as not to damage the floors. The Client agrees to be responsible for ensuring all persons they bring into the Studio wears shoe covers.
    • The Client acknowledges that the Studio has security cameras on the premises monitoring the front door of the Studio for security, safety and admission purposes.
    • The Client acknowledges that a Studio inspection shall be conducted before and after the rental period by a member of Alcove Studio.
    • Additional Studio equipment can be rented at extra cost, as set out below.
  • ADDITIONAL EQUIPMENT
    • The Client has the option to rent additional equipment from Alcove Studio for photography purposes only, which equipment may be used on the Studio premises or outside the Studio premises.
    • The rental of additional equipment can be found on the bookings page of the Alcove Studio website.
    • The additional equipment may be rented subject to availability.
    • Payment for the rental of additional equipment shall be included in the booking invoice that will be billed to the Client.
    • The Client shall be responsible for the collection and return of the additional equipment within the rental period agreed upon.
    • Risk passes to the Client upon collection of the additional equipment until such time the additional equipment is returned to the Studio premises. The Client shall be responsible for returning the additional equipment in exactly the same condition as it was when it was collected in the first place.
  • CONDUCT WHILE ON STUDIO PREMISES
    • Respectful behaviour is required while on the Studio premises.
    • Any conduct by the Client, or any persons brought onto the premises by the Client, that is deemed inappropriate or disruptive by Alcove Studio, may lead to termination without a refund.
  • CANCELLATION & REFUNDS

Cancellation by the Client:

  • In the event of the Client cancelling at least 72 hours prior to the start of the Client’s rental period, the Client shall receive a full refund of the deposit.
    • In the event of the Client cancelling less than 72 hours prior to the start of the Client’s rental period, payment shall not be refunded, and the Client shall forfeit their deposit.
    • No refund will be given for cancellations made by the Client within the duration of the rental period.

Cancellation by Alcove Studio:

  • In the event of unforeseen circumstances, Alcove Studio reserves the right to cancel a booking, and in such circumstances, Alcove Studio shall offer a full refund of the rental fee.

Cancellation by either party:

  • Either party shall be entitled to cancel immediately upon written notice to the other party, if the other party has committed a material breach of these terms and fails to remedy such breach (if remedial) within 5 (five) days of receipt of written notice requesting its remedy.
  • DAMAGES & LIABILITY
    • The Client agrees to be solely responsible for the conduct and personal welfare of all persons accompanying the Client while on the Studio premises.
    • Alcove Studio is not liable for any loss, damage, theft or injury to the Client or their property during the rental period. The Client is solely responsible for its own equipment brought onto the Studio premises. The Client is encouraged to and shall be responsible for insuring their own equipment.
    • Any damage, loss, or theft incurred by Alcove Studio or its equipment (by any means whatsoever) during the rental period, either by the Client, or by any persons accompanying the Client whilst on the Studio premises, shall be for the responsibility of the Client to fix, repair or replace, to the value (or nearest estimate) thereof.
    • Should the Client rent additional equipment from Alcove Studio, the Client shall be responsible for any damage, loss or theft of the additional equipment. This shall include damage, loss or theft caused on the Studio premises or outside of the Studio premises.
    • Alcove Studio is not responsible for any delays or disruptions on the Studio premises caused by factors beyond its reasonable control.
  1. GOVERNING LAW & DISPUTE RESOLUTION
    1. These Terms are governed by and construed in accordance with the laws of the Republic of South Africa.
    1. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.
  1. GENERAL
    1. These Terms constitute the entire agreement between the Client and Alcove Studio regarding the rental of the Studio. Any modifications of this agreement must be made in writing and signed by both parties.
    1. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall remain of full force and effect.
    1. No delay or omission by a party exercising any right or remedy under these Terms shall operate to impair such right or remedy or be construed as a waiver thereof. Any single or partial exercise of any such right or remedy shall not preclude any further exercise of the exercise of any other right or remedy.
    1. Neither party shall be entitled to assign, transfer, delegate, or cede the whole or any part of its rights and obligations under these Terms without the prior written consent of the other party.
